These Terms and Conditions (“Terms”) govern your use of the Accessibility Scanner application (the “Application”) provided by Lachlan Thompson (“Developer”). Please read them carefully.

Your purchase, access to, and use of the Application is conditioned upon your full acceptance of and compliance with these Terms. These Terms apply to all users who purchase, access, or use the Application.

By purchasing, installing, or using the Application, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you disagree with any part of the Terms, you must not purchase, install, or use the Application.

1. Description of Application

The Application is a tool designed to assist users in evaluating the accessibility of web pages. It utilizes browser automation (Puppeteer) to navigate websites and accessibility testing engines (Axe-Core) to analyze content against selected accessibility standards (e.g., WCAG). It generates reports based on these automated checks.

2. License and Purchase

Upon payment of the applicable fee, you are granted a limited, non-exclusive, non-transferable, revocable license to install and use the Application on the number of machines specified at the time of purchase.

Unless otherwise agreed in writing, each purchase entitles you to a license valid for one (1) year from the date of activation. Continued use beyond this period requires renewal or additional payment.

This license is hardware-locked and tied to the unique ID of the machine it is activated on. You may not sublicense, rent, lease, or distribute the Application to any third party.

The specific license duration and terms (if different from the standard one-year term) will be included in your purchase confirmation or agreement.

3. No Entitlement to Support or Updates

Your purchase of the Application is for the software in its current state at the time of delivery. The purchase price does not include, and the Developer is under no obligation to provide:

  • Support: No technical assistance, troubleshooting, or guidance is included.
  • Updates: The Developer is not obligated to provide updates, upgrades, bug fixes, or new versions. Any future releases are at the Developer’s sole discretion and may require a separate purchase.
  • Maintenance: No commitment is made to ongoing maintenance or continued development.

4. “AS IS” and “AS AVAILABLE” Disclaimer

THE APPLICATION IS PROVIDED “AS IS”, “AS AVAILABLE”, AND “WITH ALL FAULTS”.

You assume full responsibility and risk for using the Application. The Developer makes no warranties, express or implied, including but not limited to fitness for a particular purpose, non-infringement, or that the Application will be error-free, reliable, or secure.

5. User Responsibilities

  • Authorization & Lawful Use: You warrant that you have all necessary legal rights and explicit permission to scan any URLs or files you use with the Application. You are solely responsible for any resulting legal or contractual violations.
  • System and Resource Impact: You acknowledge that scans may consume significant computing resources and load target websites. You agree to use the Application responsibly and configure it appropriately to avoid harm or disruption.
  • Interpretation of Results: Automated accessibility testing is not comprehensive. Results require human interpretation by a qualified professional. The Application’s output is informational and does not guarantee accessibility compliance or legal conformance.
  • Security: You are solely responsible for maintaining the security of your systems, credentials, and data while using the Application.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, THE DEVELOPER SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of data, business, revenue, or profits
  • Computer system failure or malfunction
  • Legal liability from unauthorized scans or misuse

This applies regardless of the theory of liability (contract, tort, etc.) and even if the Developer has been advised of the possibility of such damages.

You use the Application at your own risk and assume full responsibility for any outcomes.

7. Intellectual Property

The Application and all original content provided (excluding open-source dependencies) are the exclusive property of the Developer.

The Application makes use of open-source components such as Puppeteer and Axe-Core, which are each governed by their own respective licenses.

8. Prohibited Uses

You agree not to use the Application:

  • To scan websites or systems without proper authorization
  • For any unlawful or unethical purpose
  • To conduct denial-of-service attacks or otherwise disrupt systems
  • To infringe on the intellectual property or privacy rights of others
  • To harvest, scrape, or extract data in violation of applicable laws or site terms

9. Termination

The Developer may terminate your license to use the Application at any time without notice if you violate these Terms. Upon termination, you must cease all use and destroy any copies of the Application in your possession.

10. Modifications to Terms

The Developer reserves the right to modify or replace these Terms at any time. Changes will become effective upon posting. Continued use of the Application after such modifications constitutes your acceptance of the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of the Application shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Refund Policy

All sales are final. Due to the nature of the digital product and licensing, no refunds will be issued after purchase.

14. Export Compliance

You agree to comply with all applicable export laws and regulations. The Application may not be downloaded or used in any country subject to United Kingdom or international sanctions or embargoes.

15. Anti-Piracy and Technical Protection

The Developer may include technical measures to prevent unauthorized use or license abuse. You agree not to bypass, disable, tamper with, or circumvent such protections.

16. Severability and Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable by a court, the remaining provisions will continue in full force and effect.

These Terms constitute the entire agreement between you and the Developer concerning the Application, superseding any prior agreements or understandings.
